Non Resident Vendors

Important things to have in place before you sell your property in Ireland

1.      If your property is currently rented out you will have to provide sufficient notice to your tenants.  Your solicitor will provide you with the necessary information required to ensure that you comply with all legislation in relation to residential tenancies.

2.      Your solicitor will need to be provided with your title deeds to allow them draft a contract for the sale.  This should be done before the property is put on the market to ensure the process is as quick as possible.

3.      You will also need to appoint an accountant who will need to assess your tax liability as you are a non-resident vendor.  A letter from the Revenue Commissioners confirming that there is no tax liability outstanding in relation to the property sale will be required by your solicitor before sale proceeds can be released.

Eligibility Criteria To Become an Irish Citizen

Adult

The Criteria for applying as an adult is as follows;

·Be of Full Age ( i.e., aged 18 or over).
·Meet the relevant conditions of residence.
·Intend to reside in the State.
·Be of good Character.
·Will attend a citizenship ceremony and make a declaration of fidelity.  Due to the COVID19 pandemic live citizenship ceremonies have not been able to take place.

Young Adult

In addition to the criteria for an Adult set out above, to apply as a young dependent adult the following eligibility requirement will also apply;

· Aged between 18 and 23 when you apply.
· Entered the State legally as part of a family unit.
· Currently attending Secondary School in the State or went directly from Secondary School into third level education in the State.
· Are continuously dependent on your parents. You are not financially independent.

Minor

A minor child is aged under 18 and who is not married at the time of the application.  The child can not make the application themselves.  It must be made on their behalf. The different types of applications that can be submitted depending on the family or the minor child’s status.

What to look out for when buying property in Ireland whilst living in another country

There are a number of factors to consider when purchasing a property in Ireland with a new to moving here to live.  The following is a list of things to keep in mind when looking for a solicitor.

1.       How are you funding the purchase?

2.       Are you providing your own funds?

3.       You will have to register for a tax number called a PPS (Private Personal Services) number with the Department of Social Welfare.

4.       Get your application in for a PPS number early as it is taking approximately three months to receive a PPS number.

5.       You will provide the PPS number to your solicitor who will give it to Revenue to pay a form of tax called stamp duty on the property purchase.

6.       Arrange for an engineer or property surveyor to look at the property for you.

Local Affordable Purchase Scheme

Is available to people with low to moderate incomes to help them purchase their first home. It is run by local authorities.

Who is Eligible to Apply?

Applicants must not own a property and they must have a right to Live in the State. Furthermore, eligibility is calculated based on income: Your income rate must be below a certain criterion. This can be calculated by calculating your gross annual income by 3.5. This figure is called your ‘purchaser power’. It must be either less than 85.5% of the market value of the affordable home or you must give proof from a bank/financial Institution that you cannot get a mortgage for 85.5% of this value. This market value of the properties is agreed by the local authorities. If you have savings above a certain amount, you may not qualify. You may have money to cover the deposit plus an additional 30,000 more. However, if purchasing power goes above 95% of market value of the home you are no longer eligible.

Provisions will also be made for:

-Divorced or separated individuals who do not retain and interest in the home previously owned by their spouse or partner.

-A limited number of second time buyers (those who purchased before, but home is now too small for their household needs).

-those who purchased a dwelling but had to sell it due to insolvency issues.
